Terms of service

These terms govern every order placed through museartis.com. By completing an order you accept them. Please read them before you buy.

1. Who you are contracting with

Your contract is with Digiboo GmbH, Schiffliweg 9, CH-8700 Küsnacht ZH, Switzerland, trading as Museartis.

2. How a contract comes about

The products shown in our shop are an invitation to order, not a binding offer. Your order is an offer to buy. The automatic email confirming receipt of your order is not yet an acceptance. The contract comes into being when we confirm dispatch, or when we hand the goods over to the carrier.

We may decline an order — for example if a file turns out to be unusable at the size ordered, if a price was displayed incorrectly, or if we cannot deliver to your address. If you have already paid, we refund you in full.

3. Prices and payment

All prices are in Swiss francs and include Swiss VAT where applicable. Shipping is included in the price — no delivery charge is added at checkout.

Payment is due when you order, by the methods offered at checkout. Title in the goods passes to you on full payment.

Customers outside Switzerland: the price you pay us does not include import duty, foreign VAT or customs handling fees. Where your parcel is printed within your own customs territory, none usually arise. Where it is not, these charges are yours to pay and we cannot estimate them in advance.

4. Made to order

Our prints are produced individually for each order. Nothing sits in a warehouse. This is why production takes a few working days before dispatch, and why we cannot cancel an order once printing has begun — see clause 6.

5. Delivery

Delivery times shown on the product page and at checkout are estimates in working days, made up of production time plus carriage. They are not guaranteed dates. If a delivery is materially delayed we will tell you and you may set us a reasonable additional period; if that passes without delivery, you may withdraw from the contract and we refund you.

Risk of loss passes to you when the goods are handed to the carrier. If a parcel arrives damaged, photograph it and tell us within 30 days — see clause 7.

6. Cancellation and returns

Swiss law gives no general right of withdrawal for goods bought online. We nevertheless grant you one, as a contractual right:

Customers in the EU and the UK may return an undamaged print within 30 days of receipt — an extension of the statutory 14-day right of withdrawal, granted voluntarily. Customers in Switzerland, the USA and elsewhere may return within 14 days, granted as a contractual right, since Swiss law provides none.

In both cases: tell us at info@museartis.com before you send anything back, so that we can give you a return address. You bear the cost of return carriage, unless the item was faulty or we sent the wrong one. We refund within 14 days of receiving the returned print, by the means you paid. Full details are in our Refund Policy.

This right does not apply to prints made in a size, framing or finish specified by you individually, beyond the options offered as standard in the shop.

If you are a consumer resident in the EU, mandatory provisions of your own law may give you a further-reaching right of withdrawal. Nothing in these terms restricts it.

7. Faults

If a print is faulty — damaged in transit, colour-defective, cropped wrongly, wrong item — tell us within 30 days of receipt and send a photograph. We send a free replacement and do not require the faulty print back; if a replacement is not possible, we refund in full. We bear all carriage.

Your statutory rights under Art. 197 ff. of the Swiss Code of Obligations remain unaffected. For consumers, the limitation period is two years from delivery.

Please note that a giclée print is a reproduction of a historical original. Plate marks, paper tone, foxing, worn lines and other traces of age visible in the source material are reproduced deliberately; they are part of the work, not defects.

8. Rights in the artworks

We reproduce works that are in the public domain, or that we hold a licence to reproduce. Each product page states which, and names the source and the rights holder where one exists.

You buy a physical print for private display. You acquire no rights in the underlying work or in our reproduction file, and no right to reproduce, resell as a reproduction, or exploit the image commercially.

9. Liability

We are liable without limit for injury to life, body or health, for damage caused intentionally or by gross negligence, and wherever the law does not permit liability to be excluded. Otherwise our liability is limited to the foreseeable damage typical for this kind of contract, and to the value of the order concerned. We are not liable for auxiliary persons to the extent Art. 101(2) CO permits exclusion.

10. Governing law and jurisdiction

Swiss law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Küsnacht ZH, Switzerland. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, nor of the right to sue at your own domicile where the law gives it to you.
